TERMS OF TRADE

General Terms

These terms and conditions govern all goods and services (plants) provided by ‘we’, ‘us’, ‘Blue Glen Natives’, to you, the customer and purchaser of the goods and services.

These terms are effective from 23/04/25. 

We reserve the right to update these terms and conditions, which will be identifiable to you via our updated terms and conditions page posted on our website.

You must be 18 years or over to purchase goods from us. The Consumer Guarantees Act will not apply for individuals, groups or organizations acquiring goods or services from us for business purposes.

Exclusion clause

We exclude any liability for any loss or damage suffered by the customer as a result of plant or container damage, or failure caused by factors occurring subsequent to the delivery or acquisition of the plants by the customer.

To the extent permissible by law, we exclude all liability we may have to you for any claim except where we have acted in bad faith. Our maximum liability to you is limited to the value of any faulty goods provided by us and we will not be liable to you for any other loss or damage of any kind however it arises.

Payment

Our payment methods are via internet banking with invoice. The plants will be dispatched once payment is received. In some instances, we reserve the right to ask for a deposit. If we ask for a deposit, you will be notified of the terms of trade for that specific deposit with our consumer agreement for contract planting.

Pricing

Order summary prices will be provided via quote including of Goods and Services Tax (GST) and delivery costs. Prices listed on our website are exclusive of GST. Delivery of goods will commence once payment has been received for customers opting for delivery. We reserve the right to change our prices on our website at any time.

Delivery

We only deliver to New Zealand addresses. Customers will be given the opportunity to pick up at our nursery location by pre-arranged appointment, in which case the goods become the responsibility and are at the sole risk of the customer upon leaving the premises.

All goods remain the property of Blue Glen Natives until full payment has been received. Costs of packaging are included in delivery costs if the customer chooses this method of obtaining the goods. Within reasonable limits we will endeavour to achieve timely dispatch for delivery of manifested goods once payment has been received.

Claims

We take care in the packaging and provision of our plants to ensure they are supplied in quality condition. Any complaints or shortages must be lodged within seven days of receipt of goods.
